More on Hayward's Personal Liability

It is clear from ongoing case law that the City will need separate counsel from Hayward.
Hayward could always hire Bobby K.

See this wrongful termination case ongoing in Maui:

"His wrongful termination and defamation lawsuit seeks unspecified “general, special, consequential, compensatory, double, treble, exemplary and/or punitive damages”; pre- and post-judgment interest; and attorneys’ fees and costs.

It is the federal discrimination claims that made the federal court in Honolulu a more appropriate place to file the lawsuit, his attorneys said.

The named defendants are Maui County and Arakawa, as mayor and personally. The county had no comment on Watson’s ruling, saying that it covered Arakawa’s role in his personal — not his official capacity.  Arakawa’s personal attorney, former Attorney General David Louie, had no comment on the ruling Tuesday."

Dang...“general, special, consequential, compensatory, double, treble, exemplary and/or punitive damages”; pre- and post-judgment interest; and attorneys’ fees and costs."

Mayor Hayward better start looking for the change in that couch.

Mayors New Theme Song - Crapped Out Again

Flat broke and busted, it just don't seem fair
The Man in Heaven, don't hear my prayer
And these dice are loaded, and I still can't win
Flat broke and busted, crapped out again

Maybe tomorrow, I'll see the light
And I'll know the difference, tween wrong and right
My ship is out there, but it can't come in
Flat broke and busted, crapped out again

And now I'm hangin on tight, to the end of my rope
Somebody call me a preacher, yeah, let's call the Pope
Just the flip of a coin, the turn of a card
I'll be back up on top, damn, I'll be livin' large

My ship is out there, but it can't come in
Flat broke and busted, all crapped out, crapped out again

Maren.....Asshat Wayward never has to concern himself about paying bills because his many GOB connections will always make sure he is well taken care of in exchange for all the benefits thrown their way during his administration. Uncle Freddie and Bobby K have plenty of dough lying around to take care of the Emperor without any clothes.

seems that when he terminates well respected/liked employees he has to do some damage control by besmirching their reputation in the media...including 'leaking' misleading information to the media. there is a pattern.

That moment when you look around and ask, "did anyone else just feel the table rotate just a nudge, like it's about to turn?"

Interesting...Maren, do you know if anyone has ever tried to sue the Mayor in his "individual" capacity?

I would think that if this new ground is broken, it could potentially open Hayward up to additional litigation from others.

Read on Rick's Blog City Council may be cowering already. Maybe if it were their money it wouldn't be so easy to allow the obvious conflict of interest. If they allow Hayward to use taxpayer funds for his individual defense, maybe the taxpayers ought to sue council.
