Congratulations Firefighters!!!!!!

Press Release

The Pensacola Fire Department is proud to announce the advancement of several firefighters today. Lieutenant Kelly Akins who has served with the department since 2012. Lieutenant Tyler Choat who has served with the department since 2007. Captain Marquette Oliver who has served with the department since 2001. Captain Jed Martin who has served with the department since 2007. Fire Marshal Annie Bloxson who has served with the department since 1993. Battalion Chief Ginny Cranor who has served with the department since 1998 and Battalion Chief Cedric King who has served the department since 1993. Congratulation’s to you all!

I am so pleased that I was wrong!

My sources tell me Sisson has changed the process for hiring and is making the decisions.  I hope the new process is well documented Sisson.  It will be part of the lawsuit.  No winging it!

Southwest Airlines Incident...How did PFD do?

Last Saturday a Southwest Airlines flight from New Orleans to Orlando had an engine issue and had to make an emergency landing at Pensacola Regional Airport.

The plane landed safely and no one was injured.

This is a perfect opportunity to assess how the ARFF and PFD did in responding to a real world issue.

I have discussed this before.

You see, at any point in time, the Airport fire department is manned by 2 people.  2 Trucks, 2 people.

The Mayor says "But that doesn't take into account Station 3 and Station 6 at each end of the runway."  He is right.  That adds 3 men on 2 engines to the response.

So a Boeing 737 declares an engine emergency with 105 lives on board and is forced to make a emergency landing at Pensacola Regional Airport and PFD sends a MAXIMUM of:

  • 8 firefighters
  • 2 ARFF trucks
  • 2 regular engines
What if Engine 6 is out at a car wreck at I-10 and Scenic.  Strike 1 engine and 3 firefighters.
What is Engine 3 is at the Roger Scott soccer game.  Strike 1 more engine and 3 more firefighters.

So a MINIMUM immediate response of 2 firefighters and 2 trucks.

Another question.  Have every firefighter at Stations 3 and 6 been trained in aviation accident responses?

So I have made a public records request so we can assess just how our PFD responded.

Record Requested: Southwest Airlines Emergency Landing at PNS on August 27, 2016 

I request:
  • the Fire engines that responded, 
  • manpower on each responding engine,
  • ARFF units responding and manpower on each responding engine. 
  • response times, 
  • incident report, 
  • time on scene, 
  • equipment dispatch logs for the entire PFD for 2 hrs prior to the incident and 2 hours after the incident. 
  • The name of the on scene commander and his entire training history. 
  • In addition, I request training summaries for each person responding to the scene in aircraft fire techniques and procedures.
Lets see how the PFD under Mayor Hayward, Automatic Aid Olson and Chief Allen responded.

Insider Deal of the Day at the City and A View of the Alphabet Man

Today another inside deal will likely be done.  This time at PFD.  Nathan Edler will likely be made a Battalion Chief.  Has he earned it?  Of course not!  It's political.  Put the resumes side by side and he loses everytime...and twice on Sundays.  Here's the details.

2 African-American Acting Battalion Chiefs will be overlooked so that Chief Allen can appoint the Union Leader that pushed Allen's appointment.  The Union Leader, Edler, up for advancement, used, without any Union vote, his position in the Union to lobby for Allen's appointment as Chief.  He called each Council member and lobbied them for Allen.  He went down and spoke for Allen.

Today the repayment is likely to be made. Allen wants the Union Leader in his stable of pet ponies.

Sit Nate, Bark Nate, Good Union Leader!

Inside cookin' with our dollars...or Allen could do the right thing?  Holding my breath!  :)

Cooper Written Reprimand...Let's break it down

Rick Outzen today posted a written reprimand of Brian Cooper regarding improper hiring and insubordination.

First and foremost, as the Mayor likes to say, the written reprimand of Brian Cooper shows that Ed Sisson, as Forest Gump would say is "not a smart man".

Lets first break down the wording of this painfully written reprimand:

  • "chose to call names to our Mayor" Did he beckon the words to him?
  • "you were found to have completed the following undesirable behaviors"  Hate for them to be incomplete.
  • "publically"  Sisson publicly needs someone to review his work before issuing!
  • "are considered to be violations of insubordination"  How do you violate insubordination?
  • "The work your do"  Sisson, did your take English?
Ed, did Jose write this?  This is a serious document and it deserved better than this.  This written reprimand clearly makes Brian Cooper's disdain for you and the Mayor appear warranted.  Why get you involved with hiring?  You appear incompetent.

Next lets look at the obvious inconsistencies with Cooper's treatment and Schmitt and Glover's treatment:

The reprimand says Cooper "hired staff without going through the proper protocol and procedure."

How about proper protocol and procedure for:

  • Rebecca McLellan
  • David Allen
  • Greg Redding
  • Rebecca Ferguson
  • Amy Workman
  • and on and on and on

Cooper had issues with improper hiring practices before but was not given a written reprimand for them.  He was reprimanded in writing for continued hiring issues.

Sisson had waived panel interviews with Tibbett to be hired, and NO adverse consequences for him.

Glover and Schmitt had never had hiring issues before, but failed to hold panel interviews and were fired.

Seems consistent doesn't it?

Cooper cussed out the Mayor and received a written reprimand.

Schmitt and Glover respected the instructions of Olson to have no discussion with anyone at the City during the investigation and were fired.

Seems consistent doesn't it?

Cooper was given a written reprimand for going outside the "Chain of Command".

Schmitt and Glover were fired for enforcing the "Chain of Command"

Seems consistent doesn't it?

The evidence against Sisson and Olson will just continue to mount!

  • Did Wilkins actually do ANYTHING in the investigation or was it run by Sisson and Olson?
  • What did Deas conversations with "Ashton" entail?
  • How much was Deas put up to bringing his "issues" forward?
  • Did Olson really tell Schmitt that Glover "needed to move on"?
  • What details will Workman disclose as to Sisson's statements about Schmitt and Glover? About Sisson or Olson's statements regarding the EEOC investigations?
  • How many conversations did Hayward have regarding the investigations with Kerrigan?
  • Did David Allen have advance notice that the Chiefs would be investigated and placed on leave?
  • Did Allen have advance notice of the outcome and the Mayor's decision.
  • How much did Allen assist in the witch hunt for Sisson and Olson?
  • How were the Council members lobbied to vote to confirm Allen?
  • How panel interviews were so important and required by Sisson for some but not for Tibbett?

Fire Union Endorses Travelin' Wu

The Pensacola fire union is endorsing Travelin' PC Wu for City Council. The Fire Department likes a Council member whose favorite lines are "We have no power!" and "My hands are tied."

Last time he ran, PC Wu told Laura McKnight that if she didn't run against him he would not seek another term as he just wanted one more term to stay involved in the League of Cities Board of Directors.

I understand now that PC has his eyes on some stupid Florida League of Cities award for 20 years of service which requires him to be in office until 2024 to qualify.


PC Wu he doesn't care about the Citizens, just selfies with politicos and a plaque for sucking his City dry for 20 years.

You see, with PC Wu it is about traveling on our nickel to resorts not about representing his constituents.

Can anyone remember one (1) piece of legislation PC has ever proposed? One!

Can anyone remember one (1) briefing he has given Council regarding what he has "learned" at the League of Cities? One!

I have a public records request in for all of PC Wu's travel expenses for the last three years!

Get ready to realize how much we the the Citizens have subsidized the Professor's retirement travels.

Get ready to choke on the fleecing of Pensacola!

Oops...Sisson Forgot to Tell Van Sickle About This or Did He?

While no longer dominating the news, the investigation into the Fire Chiefs has transitioned from a witch hunt to fire Chief Schmidt and Glover to an investigation by their attorneys into the circumstances surrounding the entire investigation.

Remember, when the Mayor made his decision about the Chiefs, I stated that once it was done, the Mayor could no longer control the story and the spin.  Lawyers, documents and depositions were in his future.  Ashton depositions are coming to your future.

Well one question to be asked of Sisson, Van Sickle and Hayward, once again on video and under oath, surrounds the alleged shortfalls in the Fire Department hiring practices.

In his report, Van Sickle stated:

"Sisson identified that the most recent example of concerns over Schmitt and Glover’s alleged mismanagement issues from an HR perspective was Schmitt and Glover’s alleged failure to follow normal hiring protocol for the January 2016 hiring round for new firefighters.

During this investigation, all parties involved agreed that the normal hiring process was not followed for the January 2016 hiring process. The primary deviation was the failure to have the applicants interviewed, scored, and ranked by an interview panel of firefighters."

Van Sickle summarizes:

"I find that neither Schmitt nor Glover was attempting to manipulate the hiring process to include or exclude any particular applicant. However, Schmitt and Glover believed incorrectly they were capable of handling the hiring process without an interview panel and without any guidance from HR. They both used poor judgment to conduct the hiring process in a manner they both agreed had not been done before. Their handling of the hiring process, from not understanding the value of a panel taking notes and individually scoring potential new firefighters; from not taking notes of any substance; from not acting to score and rank them from January 21 to at least January 26, when the application of the statutory veteran’s preference finally dawned on at least Glover, showed that they were not actually capable of properly handling the process. Additionally, their failure to properly conduct this particular hiring round coincides in timing with a disturbing level of animosity each showed toward HR, which is evidence that they intentionally ignored the proper process under the mistaken belief that they knew better than anyone else how to approach a hiring round for new firefighters."

Mr. Van Sickle, let me bring to your attention firefighter Brandon Tibbett.  You discussed him in your report.  Here is what you said:

"Tibbett was the only candidate to successfully complete the program. Tibbett completed the PAT with the PFD on December 7, 2015, in coordination with Workman in HR. (December 7, 2015, email from Jester to Workman) The HR department, apparently without Sisson’s knowledge, allowed the background check completed for the apprenticeship program to be used in place of a new background check for hiring. Tibbett was not interviewed again prior to starting his employment with the City PFD. However, Tibbett was required to complete a new drug test and the medical exam screening. Tibbett started employment with the PFD on January 19, 2016."

New Hire Checklist:
  • PAT Test...Check
  • Background Check...Check
  • Drug Test...Check
  • Medical Test...Check
What was never done?   Yep!  Panel interview.
Who approved no panel interview was required?  I understand Ed Sisson did!

But wait Mr. Van Sickle you stated previously, and let me quote:

"However, Schmitt and Glover believed incorrectly they were capable of handling the hiring process without an interview panel and without any guidance from HR. They both used poor judgment to conduct the hiring process in a manner they both agreed had not been done before. Their handling of the hiring process, from not understanding the value of a panel taking notes and individually scoring potential new firefighters;"

Mr. Van Sickle, I don't understand. It appears when you are making up charges against the Chiefs to fire them panels are required and essential, but when you are discussing the hiring process of Tibbett, you note drug tests, medicals tests and PAT tests but keep your mouth shut when no panel was required.

So Mr. Van Sickle, let me ask you: If panels are required and Sisson did in fact waive it, is Sisson not guilty of circumventing the normal process also?

Did Sisson believe incorrectly, Mr. Van Sickle?
Did Sisson use poor judgement, Mr. Van Sickle?
Did Sisson not understand the value, Mr. Van Sickle, of a panel taking notes??

No Panel...Schmidt...Fired
No Panel...Glover...Fired
No Panel...Sisson...No issue!

How to Extend a No Bid Contract for Almost Six Months Under the Radar AFTER IT EXPIRED

As noted previously, the Airport is evaluating RFPs for Airport advertising.  Emagination Unlimited was given the contract without bid three years ago by the Hayward Administration.  Over that time the Hayward administration has installed a Marketing Manager whose most relevant previous experience was manning the customer service line at the local air conditioning contractor.

In typical Hayward insider dealing, the three year contract with Emagination expired in March 2016.

Was a new RFP issued?  No!

When someone finally realized that the three contract expired, on JULY 1, 2016 Airport Director Dan Flynn sent Mayor Ashton Hayward a memo stating:

  • "Emagination Unlimited has been the contractor since March 2013"
  • "The current contract has expired and staff is preparing to solicit proposals via a publicly advertised Request for Proposals"
  • "It is necessary to continue the current contractor on a month-to-month basis during the RFP period to ensure the availability of required services."
That was July 1, 2016.

So a month later on August 5, 2016, the City signed a month to month contract with Emagination Unlimited retroactive to March 29, 2016.

  • How can a Airport Marketing Manager that only manages one contract allow that contract to EXPIRE and not recognize the expiration until three months later?
  • How did bills submitted by Emagination Unlimited get paid between the contract expiration in March 29, 2016 and the month to month contract in August 2016?
  • How does a retroactive contract work exactly?  Is that legal?
  • Since Emagination did not have a valid contract with the City for 6 months, was it falsely representing itself as the City's marketing and advertising contractor during that period?
Mr. Barker, how is this in compliance with internal controls?

Junior varsity financial operations folks!  After all it's not their money!

This kind of contract shenanigans doesn't happen unless the "relationship" with the contractor is ultra cozy!

Airport Advertising RFP

Proposals were due August 16, 2016 for a three-year contract for the Airport's Marketing and Advertising.

Here is a link to the RFP.

Clear in the RFP is that the winner will report to the Potted Plant.

Staff Oversight:
Services of the firm shall be under the general direction of the Marketing Manager or their designee who shall act at the City’s representative during the performance of the contract.

I received the photo below from a reader.  Normally I would not post a photo of an event like a wedding, but when the Airport Marketing Manager is getting married and its important to invite the Airport's advertising contractor, you have to question her independence.


  • Does the Potted Plant sit on the selection committee?
  • Does she chose the members of the committee?
and the biggest:
  • Does attendance at the Marketing Manager's wedding and how nice your GIFT was have influence on her decision?
  • Did she declare the gift from a City contractor?
Who else got an invite?

Andrew Tallman (McKay) Addresses Police Issue with Union and the Mayor

AM 1620 tried to get the Mayor to address the concerns of the Police union this morning on the radio.

Hayward just dribbled "contract negotiations", "positioning", "part of the process"

Police officers, please remember in 2010 when he was running for office, Hayward made the following statements at a reception at Billy Barnes Union Hall.  I was there.  I remember.

  • "F$#@ Dick Barker.  When I'm elected Barker is F$#@ing fired."
  • "When I'm elected, I will sit at the negotiating table with you personally."
  • "Supporting our police officers will always be my number one priority."
Is he keeping his word?

Now lets break down his statement today: 

"The police budget has increased each year since I have been in office."   True...but the rest of the story.

FY2017 Budgeted Salaries  $9,100,300

Decreased salaries?  How does that work?

Flat Overtime with decreased Salaries?

Budget Questions That Make You Think

I enjoy the City of Pensacola budget.  It is one of the best books of fiction out there and is free!

One section that is always a hoot is the Statistical section.  It is full of ridiculous facts like the number of stop lights and miles of paved roads in the City.

But every year there are a few that leave me scratching my head as if to ask Whaaaaat? or Hooooow?

Here's a few that I can't figure out?

Additionally, one aspect I laugh the most about is how much of the Budget is just "change the dates and reprint" or "same as last year"

One example is the 'General Information Concerning the City".

It reads, directly next to a photo of all five flags INCLUDING THE CONFEDERATE FLAG:

"Pensacola is nicknamed “The City of Five Flags” due to the five governments that have flown flags over it during its history: those of Spain, France, Great Britain, the Confederate States of America, and the United States. Other nicknames include “World’s Whitest Beaches” (due to the white sand prevalent along beaches in the Florida panhandle). “Cradle of Naval Aviation” (the National Museum of Naval Aviation is located at the Pensacola Naval Air Station, home of the legendary Blue Angels), “Western Gate to the Sunshine State,” “America’s First Settlement,” and “The Upside of Florida.”

The Upside is relegated to the DownSide of the nickname list.

Police Union Humiliates Hayward...Press Reports Nothing

Sometimes the story is in the ads!  The cops are done with Hayward's lies too!

The IN Weekly this week ran an ad by the Police Officers Union.

Airport / Mayor's Office Explored Circumventing Council with Innisfree Jet Center Deal

Documents reveal that in November of 2011 as the issue of whether or not Mayoral supporter Innisfree could be made an FBO or an SASO at the Airport, the Airport Staff and the Mayor's office directly discussed whether either the minimum standards changes or a "lease amendment" would need to go before City Council or if the Mayor's office could just amend the lease.

Yes, the Mayor's Office directly investigated circumventing the approval process to give the Mayor's supporter exactly what he wanted with no outside approval.

November 15, 2011 - Mayor's office sends an email to the Airport Director stating:
"I need be briefed on the Airport's propose min standards specifically, the FBO issue"

November 16, 2011 - Mayor's office sends an email to the Airport Director stating:
"I need to be briefed on the FBO and Julian issue ASAP"

November 17, 2011 - Airport consultant Michael Mulroney advised the Mayor's office:
"You asked for authority on the process of amending the Minimum Standards. The following is from the federal advisor circular on Minimum Standards. As you can see there is no requirement per se for a process prior to adoption of change. We did learn that airport staff has told some airport tenants that they would be involved in future changes to the Minimum Standards."

November 17, 2011 - Airport consultant Michael Mulroney advised the Mayor's office:
"Attached is a preliminary draft lease amendment clarifying Aerose's role as a SASO. This preliminary draft is a work in progress. With your approval Melinda will present it to Aerose for approval and acceptance. The target schedule for Aerose's acceptance of this amendment is the week of December 4th."

Proposed Innisfree Amendment

November 18, 2011 - The Mayor's office asks the City Attorney the following:


Does an amendment of the min.standards for the Airport operations have to be approved by

Does an amendment to an existing lease to an airport tenant have to be approved by council?

If so, what is the legal authority?"


  1. The City's consultant had the lease amendment to give Innisfree everything already drafted.
  2. The Airport Director was willing, with the Mayor's office approval, to merely get Innisfree's approval and let them begin operations doing exactly what they wanted within 2 weeks.
  3. If the City Attorney had ruled in his favor, the Mayor would have executed the amendment for his supporter with no Council input.

Is Expedited Road Plan a Potential Windfall?

Why would our City borrow $15 million dollars to pave 10 years worth of roads in the next 3 years?

Sources tell me that Ashton Hayward is NOT leaning toward a third term.  Once out of office his ability to drive work to contractors will end at that point.  One such contractor is Roads Inc. who has done a large portion of the City's work during our Mayor's tenure.  The question being asked by many...has this helped fund projects & other developments and potentially advanced the costs of passive partners???

After all Redfish Harbor, in which the owner of Roads Inc. and Hayward are partners, does owe its lender about $5 million.

In all likelihood, no ONE contractor would win all $15 million in road work for the City in the next 3 years but:
    • Certain contractors could easily do a third or half of the work.
    • Other contractors could not take on as much County or State work with a load like 10 years of City paving.
This would leave a well financed road contractor free to absorb as much work as they can do.

This boom could create the capital to finance other developments to the benefit of ALL its partners.

Those developments may be completed right around the time the Mayor's term ends.

After all, a Two-Term former Mayor needs either a J.O.B. or a check once he's out of office. 

Is there any other explanation for this mess???

Timeline of Innisfree FBO process

Last week I posted the letter from Rusty Wells approved by the Airport Director to Innisfree Jet Center demanding they cease performing unauthorized services for aircraft at Pensacola Regional Airport.

Below is a timeline of events in the Innisfree Quest to become a Fixed Base Operator.

  • 7/29/2004 - Lease for construction and operation of Private Corporate Aviation Facility
  • 5/8/2008 - Amendment #1 - Allow installation for fuel tanks for self-fueling
  • 8/17/2009 - Airport allows Innisfree to sublease of space to Skywarrior
  • 3/22/10 - AMCG's review of Minimum Standards sent to Innisfree
  • 5/4/2010 - Rusty Wells letter to Innisfree restating violations of lease provisions with City
  • 05/13/2010 - Innisfree and related entities begin funding Hayward campaign
  • 7/28/2010 - Email from Airport Staff to Aviation Management

What does the above show?

  • Innisfree wanted fuel service for many years
  • The City resisted.  In fact, the City Attorney sent a letter in May 2010 that Innisfree should comply with its lease and stop fueling others.
  • Innisfree began funding the Hayward campaign.
  • Shortly after being sworn in office Hayward begins process to assist Innisfree.
  • The City funded a $18,000 study to attempt to lay the foundation for Innisfree as an FBO.
  • The funded study essentially says Innisfree can't meet the current FBO requirements.
  • The City reassesses and then moves forward with changing its standards to merely allow Innisfree to just do what it wants.  Mainly, sell fuel to others.
  • The Office of the Mayor pushed this agenda.
  • The Mayor's staff worked hand and hand with Innisfree to fight the current FBO in their objections.
  • City Council was not provided the entire history of this situation when asked to approve it.

Ashton Hayward...Bought and Paid For

In documents made available by the FAA, Pensacola's Airport had repeatedly over the years had issues with Innisfree Jet Center violating its lease at the Airport.  Violations included:
  • Providing fuel to aircraft it did not own and that were not owned by an affiliated entity.
  • Subleasing portions of its premises to other entities

These violations occurred from 2004 through 2010.  In fact, a April 2, 2010 draft letter from then City Attorney Rusty Wells stated to Innisfree's owner that was later modified "to reflect a kinder/gentler approach":

"I have also reviewed a great deal of correspondence between you, your representatives and airport staff spanning several years in which the airport's position has been clear, simple and direct on the point that you are not authorized to use your fueling facility to provide fuel or any other related service to any aircraft that you do not own or that is not owned by an appropriate entity which you own or control. Consequently, the purpose of this letter is to direct you to cease these activities immediately, and to provide a reasonable but short amount of time for you to remove tenants at your earliest convenience."

Wells letter continues:

"Mr. MacQueen, the correspondence I have reviewed reflects a consistent pattern over several years of you and your representatives constantly pestering the airport staff for the right to fuel other aircraft when you have been advised from the very beginning that this would not be allowed.  In addition, you are not an FBO, and because of your constant pestering, the City of Pensacola has recently spent a substantial amount of money on a consultant to document that fact and also the fact that you are not in a position to become an FBO."

The kinder/gentler letter is at the same link and was sent to MacQueen on May 4, 2010.

So the City, the Airport and the FAA informed Innisfree they could not just do what they want.

So what happened?

Wow! Missed This...Innisfree Jet Center Calling It Quits...Settles Alleged Airport Corruption Allegations

Didn't see it in the press.  No real coverage but big news at the Airport.

Corruption Allegations?  Pensacola?

Julian MacQueen is giving up on his Fixed Base Operation at Pensacola Intergalactic.  MacQueen started the Innisfree Jet Center as an upscale alternative to the Airport's other FBO Pensacola Aviation Center.  The Innisfree Center was to be a high end facility which attempted to cater to wealthy travelers.

During the July 2016 City Council meeting, Council approved the assignment of the Innisfree lease to Pensacola Aviation who will take over the space.

In exchange for approving the assignment, Pensacola Aviation agreed to drop their complaint against the Airport for illegally allowing Innisfree to operate a second FBO at the Airport and making political accommodations to Innisfree.  

In the complaint at the link below, Pensacola Aviation alleges that:

"Innisfree is owned primarily by Julian MacQueen, a well-known hotelier and friend of the Mayor of Pensacola."

it continues:

"This complaint arises out of the Respondent's manipulation of the Airport's Minimum Standards to reduce requirements for FBOs in order to enable a politically connected party to sell fuel without making an appropriate investment in the Airport."

The complaint is not very flattering of the Mayor's former Chief of Staff's actions.

The complaint details the Mayor's alleged actions to deceive City Council on the appropriateness of making Innisfree a FBO able to provide fuel to aircraft.

"The March 5, 2012 Committee Memorandum (the "Memorandum") prepared by or on behalf of Mayor Hayward contains outright misstatements, all of which boost Innisfree's effort to obtain the right to fuel independent aircraft."

Lying to Council....Na!  They wouldn't do that would they?
Guess it is all in the context!


  • How much have been spent in legal fees defending this Hayward folly?
  • Was Council briefed on the allegations?
  • Was this an assignment or a settlement?

    Its stated purpose is:

    "Stay updated on the petition to recall Mayor Ashton Hayward because of his clear lack of concern for public safety and historical preservation in Pensacola"

    Someone is so upset about old home demolition that they are calling for recall?

    Hayward's Redfish Harbor All In For McNesby!

    Looks like Mayor Hayward and his partners are allowing Ron McNesby to use the Redfish Harbor land for a campaign sign.  Wooden framed signs aren't a drive by effort.  They require permission.
