CRA Real Estate Debacle

When you ask why the Hawkshaw property was not sweetheart dealt to any of the proposers, you need to know the CRA rules and responsibilities.

The bylaws of the CRA state:

The sale, lease, disposal or transfer of CRA real property, or any interest therein, shall be consistent with the Act and approved by City Council. The Board shall strive to obtain market value for the sale or lease of any CRA-owned land, or clearly state for the record the reason(s) the transaction is below market value."

CRA Bylaws

The fair market appraisal for the property was $1,740,000

Proposals Received Purchase Price     Percent of FMV of Property

  1. Whitesell - Hagen    $1,280,000            73.5%
  2. ITEX                        $1,000,000            57.5%
  3. Gunther                    $1,100,000            63.2%
  4. Granger                    $1,200,000            70.0%
  5. Aragon                     $1,309,000            75.2%
What could the CRA state the reasons for such a deep discount on the property are when you look at the insider GOB nature of all of the people proposing.  Anyone ever heard of the following po'folks who proposed?

  • Bob Montgomery
  • Jim Reeves
  • Justin Witkin
  • Neal Nash
  • Eric Nickelsen
  • Sonny Granger
  • William Whitesell
  • Levin Rinke
  • Robby Booth
Any Irish Politicians in that group?

Sadly, this fact wasn't even discussed.

No one ever discusses giving Quint Studer a discount off of Fair Market Value when he is involved with a deal.

Why is that?  Full price for Quint....25% off for Good Ole Boys?

Updated: Viewpoint: CATFISH at 4am this Morning?

OK 1st of all I am CATFISH,and I never have been paid for doing nothing in my life. I am sure you all have a task they do daily that most of us would find absolutely ridiculous. Before speaking of someone you should do your homework and know the facts of what your are claiming. None of you have a clue as to what work is done on the 7th floor, other than what you read in a sore losers blog, listen to on a whiny needs to feel important old man's radio show or maybe read in an article fueled by a person who feels entitled and didn't get their way. Why don't each of you stop your bitching and grudge holding and look at the many positive things Mayor Hayward has done and continues to do for the City of Pensacola. Everyone on the 7th floor works hard at their jobs that pay to support their families. You all realize you are attacking people who are working instead of laying around bitching about a jobs they wouldn't Last a day in, all while praying the mail runs on time with their monthly check. Please again before Spewing your envious hatred towards someone doing the best for a City full of people not yet accustomed to the fact that positive change takes time and when done right will have ups and downs. No one here is a miracle worker and could do what Pensacola needs overnight. I understand most of the citizens in this city are the impatient type, always wanting better, but not willing to help, only complain. It's the same no matter where you go. Oh and just a little FYI to you haters, for every complaint that comes across the desk of that poor little girl who gets paid to do nothing, there are 4-5 positive ones praising our GREAT Mayor, THANKING HIM FOR WHAT HE'S DONE AND CONTINUES TO DO FOR THIS CITY. MAREN, GET A NEW HOBBY HOBBY, THIS ONE IS OLD AND TIRED. GO MAKE A NEW ENEMY AND BLOG ABOUT THAT. Change is almost always good!

August 28, 2015 at 4:00 AM

What do we learn from the viewpoint above:

  1. CATFISH was either just going to bed or just getting up.
  2. CATFISH finds the daily summary "absolutely ridiculous".
  3. I'm a sore loser.  Did I lose something?
  4. I believe CATFISH takes a stab at Mr. Outzen.
  5. Who could CATFISH be talking about when he states "maybe read in an article fueled by a person who feels entitled and didn't get their way" Hmmm?
  6. CATFISH doesn't know that Eric Olson is lazy.
  7. Overnight...CATFISH its been half of a freaking decade already.
  8. Are citizen's spewing? The people who pay your paycheck are spewing?
  9. Ashton is not an enemy.  He is our Mayor.  He works for me.
Eric Olson opened this barn door.  Now the receptionist feels empowered to lash out at Citizens.

Nice book report CATFISH.  You should include it on the 7th floor news summary.

Closing time, you don't have to go home but you can't stay here.

Not Enough Sanitation Drivers...but TWO (2) New Asst Administrators

In the email below, City Administrator Eric (Code Red) Olson is informed why a Citizens trash was not picked up on the scheduled day.

Our Mayor has plenty of money for Assistant City Administrators to prop him up, summarize the PNJ, give no bid contracts to cronies, have speech writers and PIOs, BUT NOT ENOUGH FOR THE PEOPLE THAT KEEP OUR TRASH FROM PILING UP.

And what is Eric Olson worried about?  What address an email came from.

You can't make this mismanagement up!

Can the Speechwriter drive a truck?

Klyn remembers speaking to Mr. REDACTED on Friday and she did inform him that it was an "open route" (meaning no driver was available to start the route in the morning) but advised him that the garbage would be picked up by the end of the day. Crews began working the "open route" after completion of their own routes at approximately 2:30 p.m. on Friday but didn't complete the route until approximately 6:00 p.m. . Unfortunately, this situation occurs when we are short drivers. Currently we are short one driver due to a retirement and on Friday we had five other drivers out due to funeral leave, sick leave and job injury. The past few weeks have been very tight for drivers due to those who have been out, but we've always completed the routes by day's end. Certainly, residents living on routes affected by a driver shortage often get anxious about the timeliness of their garbage collection and call our office late in the day. However, it's a rare occurrence that their garbage is not actually picked up on the scheduled day.

This afternoon I had the supervisor go out to the location to verify that the garbage was actually collected on Friday and it appears that the containers on N. Donelson Street were all emptied on Friday as none were at the curb for pickup today and we haven't received any calls today reporting missed garbage from the area. There were a couple of containers out on Chase and Coyle that the Supervisor is having emptied today even though they don't appear to be misses from Friday since neither container is overly full. The supervisor did say that the regular route driver (who is out on injury) normally collects this area in the early morning to avoid the traffic, so for collection to not happen until late afternoon creates quite a disruption for customers. Hopefully, this situation will resolve itself within the next couple of weeks when the regular driver is able to return to full duty. Until then, I will have the Supervisor monitor the area to make sure collections are made on the scheduled day.

Dear Ms. Canada-Wynn,

I am writing to advise you of a situation occurring in your district. We live in the first block of North Donelson St. We have approximately ten residents and two businesses that depend on the city to collect our garbage. West Chase also seems to be affected. For three Friday's in the month of July, we have had no garbage pick up.

The first week that was missed, no truck ever came by to pick up our garbage. Most of the residents simply left their cans on the street until the next week. The second week, our garbage was collected. Last week, the garbage again was not collected. We called, and a truck was sent to collect the garbage of the residents of North Donelson St. late Friday afternoon.

Again today the garbage was not collected. My husband called and was told that we live on an open route, and our garbage would only be collected when they could get to it.

I find that an unacceptable answer. We and the other residents of Donelson St. and West Chase St. pay for garbage pick-up, and we have the right to expect it to be collected every week not whenever they can get around to it. I would think this is also a sanitary issue to not have garbage collected on a regular basis.

I would appreciate it if you could look into this situation.

Thank you for your attention to this matter.

City Pays Receptionist To Read the PNJ and Write Book Reports on the Articles

Here’s what is in the news today for the City of Pensacola,

Our City Moves Forward, Opinion article

The article begins with the Mayor’s meeting with the Singapore Ambassador to the U.S. and then moves on to speak about the loss of the $20 million Center for Entrepreneurship and how the Studer’s, UWF, and the C enter are all moving forward. At the end of the article it does state that the city needs to become more professional and consistent with a clear process for development at the park. In the closing the article states “We have no doubt Mayor Hayward is working hard to do what is best for the city that he loves”, but his staffing decisions matter. They seem to be surrounded by questions that carry a perception of politics or favoritism. They believe he is obligated to justify the propriety of his choices to the people who finance him.

And that all of the news for the City of Pensacola on Wednesday, August 05, 2015.

Here is what is in the news today for the City of Pensacola,

Ambassador visits from Singapore

Singapore’s Ambassador to the United States was in Pensacola on Monday August 3, 2015 discussing the joint venture that will take root here in Pensacola. The construction of this $ 37 million VT Mobile Aerospace Engineering Facility is due to begin Janurary, 2016 and will be operational in early 2017.

Letter to the editor discusses Lumon May traffic stop. Letter titled Missing Moral Compass. In the writer’s opinion Lt. Rodney Eagerton should be removed from the Pensacola Police force because his fear of political influence bewiddlers him from doing his job. He believes that officer Caitlyn Grantham should take his place.

DIB Preparing to WASTE Members Money

Dancing John Peacock, Chairman of the DIB, has a great new idea to waste DIB dollars.

Dance steps!  Yep, wasting tax dollars on dance steps to be placed around Downtown Pensacola!

In the email below to Email Police Chief Eric (Code Red) Olson, Fred Astaire Peacock is itching to pitch the CA on his great idea.

Folks will come from miles around to CHA CHA on the streetcorner!

You can't make this stuff up!

By the way, Code Red You Can't Handle The Truth Olson, Peacock used his business email for DIB business therefore it is not being retained by the DIB as a Public record according to State Law.  Call Greg Marcille and report him!

Let me quote you Code Red Olson "So, if I see something that I know is wrong that is persistent and that I know I can do something about, I will."

So Mr. Money Where Your Mouth Is, what are you going to do about the Mayoral appointed DIB Chairman using a personal email to conduct DIB business which would keep this email from being preserved by a government entity responsible for retaining it under State Public Records laws?

Bueller?  Bueller?  Targeter!!

A Picture is Worth 1,000 Words

When driving by the Tech Park on 9th you may (or may not) notice the sign above.  A reader pointed it out to me.

CBRE and Beck jointly marketing the Tech Park.  Hmmm!
Justin Beck & Lee Ann Korst.  Hmmm!
Tenant at the CMP and the Listing Agent for the CMP.   Hmmm!
Client of Beggs & Lane and Agent who still has a listing after B&L ran off Studer. Hmmm!

Who will CBRE propose to buyers?  Tech Park or CMP?
Anyone wonder if CBRE and Beck have discussed the CMP?
Do CBRE leads and proposed projects impact the value of Beck's investment at CMP?
Can Beck steer CBRE to projects that maximize the value of their investment?
If Beck doesn't like a proposed project, does it's law firm tank the deal with lease issues?
Does value for Beck investment increase if more CMP land is for public use or private use?

PNJ Editor Describes Fountain Interaction with PNJ Reporter

In an interview this morning with AM 1620, the PNJ Executive Editor details how her reporter was threatened by Tamara Fountain that if he didn't give some "kind press" an old police report about him would be released.

Pod Cast of Lisa_Nellessen-Lara_-_Executive_Editor_Pensacola_News_Journal

How does Tamara Fountain get an old police report?  I have made a public records request of the last five city employees to access the reporters police reports in the City system.

Council Meeting Debrief...My Takes

Yes it was a formality but Council as a body once again showed why they truly are irrelevant.  A rubber stamp group mandated by the Charter.

Here is my take on last night:

  1. With a room full of people, Council would not rearrange the order so that people could speak, making them wait hours while such pressing business as setting a date for food truck regulation discussions and extending Al Coby's contract were addressed.  What the Hell-en?  Chalk that one up to business as usual.
  2. PC Wu will do anything to keep his City paid retirement travel flowing.  I have seen his pony show too many times.  It was just a matter of when.  Citizens...blah, blah, blah...never happens again...blah, blah, blah...Vote for the Mayor...What time is my flight to some League of Cities boondoggle at taxpayer expense? What value has the City received from his ever increasing participation in the League? Now he is on the National Board...good thing, he has already stayed at every five star resort in Florida. He needs someplace new.
  3. I loved the guy that stated a few weeks ago the Mayor was discussed as a possible congressman and now look at him.  That one rang in the Mayor's ear.  For him, it's all about HIS perception.
  4. Andy Terhaar was quoted as saying “This was an egregious error in judgement, and I think Mr. Olson knows what he did was wrong,” then the Mayor's boy votes as he was told. Roll over. Vote! Good Andy!
  5. Larry Johnson...whatever.
  6. CNAP is a force that can mobilize folks.  Hope they remember who supported the Citizens and who didn't when elections come around.
  7. Thank you to the members that did vote to support the will be remembered.
  8. Eric Olson not only brought shame on himself, the City, and the Mayor but I bet Admiral Eric Olson is not going to enjoy every google search of his name reflecting your misdeeds.  LOL
  9. Any hopes Hayward has of further office just keep dwindling away and having his police look up reporters records is just inviting the next crisis.
  10. You opened the door Mayor by not taking Olson out.  Now you get a lawsuit complete with depositions of YOU, OLSON and the rest of your clown show.

Once again the courage of some on Council was overshadowed by the politics of others on Council. Unfortunately, guilt by association for those that continually strive to do the right thing.

The PNJ photo below says it all!  That is a Mayor who wants to hear from the Citizens!  Photos like that would not be allowed of you if Aunt Ginny was still there!  LOL!

Eric Olson Broke His Own Policy and Has No Honor!

Eric Olson targeted Melanie Nichols.  No question.  Here are the facts and they are undeniable (even to Mr. Levin):

  • On July 2, 2015, Eric Olson called Melanie Nichols boss to allege an improper action of using her government email for "personal business".  That personal business was not really "personal" but related to the City. Link-to-Olson-Phone-Record
  • Only July 7, 2015, Eric Olson put out an email to department heads that stated:   "As a reminder – it is a violation of federal agency policies if an employee of one of those agencies uses his or her email account to conduct personal business. The clearest example in our area is when employees at area military installations use their .mil (,, etc.) email accounts to correspond with City employees about matters that are not for official Government business. If you receive inquiries from someone using a .mil or other federal email domain that is not related to official Government business please politely remind the sender to communicate from his or her personal account."  Link to Copy of Olson Email

At this point, Mr. Olson asserts that Melanie should not have sent the email from her account to the City and has instructed the City employees what to do if someone using a federal account to correspond with City employees about matters that are "not official government business"

Now here is where the deceit and lies surrounding Olson's actions regarding Nichols fall apart.

On July 20, 2015 at 7:30pm Kris Tande, a retired Navy Captain who works in Senator Rubio's local office sends an email to Eric Olson which states (spelling errors are left in):

"I know the VA has been interested meeting with apprpriate city staff to discuss. Evidently its not appropriate for then to reach out to the city. Perhaps you can have staff reach out to them and get a brief on what its all about and possibly a larger venue in the future."

The email is concerning veterans issues.  The email is sent from:

The emails are below in their entirety.

Questions that prove Olson has no honor:

  • Was the email from friend Kris Tande, from the office of Senator Marco Rubio of the Great State of Florida, or from a local volunteer for veterans?
  • If the email was on behalf of the Senator would it be so poorly spelled and informal?
  • Does the office of Senator Marco Rubio conduct official Senate business at 7:30pm and sign the email Vr Kris (with no last name or official contact information)?
  • If a personal friend using his US government work account, why did Olson not ask his friend to use his personal email according to his own policy?
  • Didn't Olson violate his own policy?
  • Is the whole conversation meant to back channel do what the VA can not do according to Tande himself?
  • Olson acting on the email's requests also violates his own policy.
  • Why did Mr. Olson not send an email to Senator Rubio informing him of Mr. Tande's use of his senatorial account for personal business?
  • Why was it right to inform on Nichols but not on Tande?
  • Shouldn't Olson lead by example?
  • Shouldn't Olson punish himself for breaking his own rule?
  • Is this a do as I say not as I do, Mr. Olson?
Eric Olson, you have no honor!
Eric Olson, you targeted Melanie Nichols!
Eric Olson, when your buddy broke YOUR rules you did NOTHING!
Eric Olson, you broke your own instructions!
Eric Olson, you have brought shame on the office of the Mayor!

Has Olson Committed a Crime?

Federal Lying Statute—No Oath Required

Businesspersons must be especially aware of the federal lying statute contained in Title 18 of the U.S. Code Section 1001, which states that: “(a) Except as otherwise provided in this section, whoever, in any judicial matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully (1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact; (2) makes any materially false, fictitious, or fraudulent statement or representation; or (3) makes or uses any false writing or document knowing the same to contain any materially false, fictitious or fraudulent statement or entry shall be fined under this title or imprisoned not more than five years or both.”

Under this statute it is a crime to knowingly and willfully make any materially false statement concerning any matter within the jurisdiction of the United States. The falsehood must be material; but this requirement is met if the statement has the “natural tendency to influence or [is] capable of influencing the decision of the decision making body” which receives the false statement. This statute has an extraordinarily wide scope. Unlike perjury, the false statement need not be given under oath. Any statement, whether made orally or in writing, can violate this law.

The statements need not be made in a formal setting. Any false statement made to any federal agent is enough. This is true even if the statement was not recorded and no transcript was made. (Often the only evidence of the false statement consists of notes made by the federal agent). It is not necessary that the government actually be deceived or misled. Unlike obstruction of justice, there is no requirement that the person making the false statements be aware of a government proceeding and intend to interfere with that proceeding. In fact, it is not even a requirement that there be any sort of judicial or other government proceeding. Any false statement made to any federal employee can be sufficient to violate this law. Martha Stewart, for example, was convicted of this crime because she made false statements to employees of the FBI and the SEC. Her lies were not made in a formal interview, and the only evidence of what she said was in the notes and recollections of the federal employees involved.

In fact, this crime can be committed even without making any false statement to a federal employee. All that is required is that the false statements have some connection to some matter within the “jurisdiction of the…United States.” Persons who lie to state agencies can be convicted of this crime if statements to that state agency might influence the functioning of federal agencies.

People have been found guilty of this crime because they lied to private contractors hired by a federal agency. In April 2004, several executives at Computer Associates, the giant software company, were charged with this crime; three of them have pleaded guilty to the charges. They did not lie to any federal agent. Instead, they were charged with making false statements to attorneys working for Computer Associates who were conducting an internal investigation of allegations of improper conduct within the business. Since this internal investigation concerned activities that were within the jurisdiction of the United States, the government asserted that lies to the business’ attorneys were crimes. Prosecutors stated that the executives knew that their statements would be turned over to the government and because of this, they needed to tell the truth.

How to Recall the Mayor...This is not that hard.

City of Pensacola Charter on Recall

Section 7.01. Recall.
The qualified electors of the City of Pensacola shall have the power of recall to remove the Mayor or a Member of the City Council in the same manner provided by general law in Florida Statute §100.361, as that provision may from time to time be amended.

Florida Statute on Recall 100.361

  • Must be City residents to sign petition and to vote
  • A petition is prepared up to 200 words stating reason for recall
  • Only 5% of registered voters must sign the petition to move a recall forward (in Pensacola that means about 1,800 signatures)
  • All signatures must be obtained in 30 days from the date first petition is signed.
  • Mayor Hayward would qualify for recall under either Neglect of Duty or Incompetence
  • The Mayor then has to write a 200 word summary on why he is not incompetent
  • Then the City must print both 200 word summaries on a document called a Recall Petition and Defense
  • The recall committee must get 15% of registered voters to sign the Recall Petition and Defense over 60 days from receiving from the clerk.
  • If the 15% of registered voters sign the petition, the person being recalled can do one of two things: resign or face recall.
  • A special election is held that states two options:
    • Ashton Hayward should be removed from office.
    • Ashton Hayward should not be removed from office.
  • Anyone wishing to fill the unexpired term must also run on the same ballot with the person receiving the most votes replacing the Mayor should he be removed.

Hi Alison,
Thank you for sharing the pics and your experience while biking around our great Downtown.  The agenda for this month's Parks and Rec Board meeting is already set as the meeting is this Thursday morning.  I will, however, bring up the topic of bike racks during the new business portion of our meeting to at least begin a discussion.

As always you are welcome to come to the Parks and Rec Board meetings, maybe we can add the topic of bike racks to our June meeting and you could share more pictures and personal experiences.

Mayor Immediately Goes to Kerrigan

I recently made a public records request of ALL emails to or from the Mayor for a three day period.

What I found was rather shocking.  Can you guess how many emails the City server reflects the Mayor sent in a three day period?

Yep! Three! Drei! Trois! Tres! San! Tre! Tria! Okuthathu! Tri! Selase Thalatha!

I asked for "All emails sent or received from Mayor Ashton Hayward's city email accounts and his yahoo account from 12:01am on Tuesday August 4, 2015 to 12:00pm on Friday August 7, 2015"

If you got an email from the Mayor during that time, forward it to me or let me know so I can go visit with the State Attorney.

I got no emails from his account.
I got no emails from his account

So who did get emails.

His "Executive Aide" Zach Michael sent one to a Citizen from his account.

Then on Friday August 7 at 9:02 am the Mayor forwarded the class action lawsuit against the City to Bob Kerrigan.

Kerrigan responded 25 minutes later.

A simple legal issue. I would send to John D and he can start on it. He will best be able to advise you. Don’t worry about this one. If the fees are illegal the city will have to reimburse the customers some amount and that would be a compromised settlement amount.

Mayors Puppet Master Kerrigan Attacks Studer

This post on his blog is like a poorly written DicksBlog post but a blatant attack on Quint Studer.  Is the Mayor's office (ie Kerrigan) wanting to go to war with Quint Studer?

Update: Today's City Council Meeting...Handicapping the Vote

On the motion to add a No Confidence Vote to the Thursday Agenda here is my take on who the Council will support...the Citizens or the Mayor and his Tattle Tale:

  1. Wu - Tattle Tale (Wu will hem and haw and then say its a tough one and vote for the Mayor)
  2. Myers - Citizens
  3. TerhaarTattle Tale
  4. JohnsonTattle Tale
  5. Wingate - Citizens
  6. Spencer - Citizens (only because its his district)
  7. Cannada-Wynn - Citizens
  8. Bare - Citizens
This vote should be unanimous for the Citizens but Council (as a body) is spineless against the Mayor.  Even the Mayor can count to 5.

Mayor should have dealt with his misbehaving busy body before it got to this but that would be "leadership".

Motion fails 5-3 (six votes required)

  1. Wu - Mayor but Flip Flopped to Citizens (even gave his impassioned statement exactly as I stated)
  2. Myers - Citizens
  3. Terhaar - Mayor
  4. Johnson - Mayor
  5. Wingate - Citizens
  6. Spencer - Citizens
  7. Cannada-Wynn - Citizens
  8. Bare - Citizens
It is on the agenda.

Mayor Brings Out His Business Partner, Fred Levin, to Defend Him

Fred Levin is weighing in on the Hayward debacle now.  In a letter to the Inweekly and PNJ, Levin comes to the defense of his business partner and client demanding everyone to begin kissing the ring again.

For those unaware, the Levin firm represents the City of Pensacola in its BP claims.  The Consortium of firms also includes Beggs & Lane. Hayward appointed them without soliciting bids.

Mr. Levin is also partners with the Mayor in 349 LLC which owns the old Hallmark Elementary school.  The original partners were:

  • Fred Levin
  • Ashton Hayward
  • Fred Vigodsky
  • Matt Pair
Mr. Levin holds a $1 million mortgage on the building.

Beggs & Lane Was For It Before They Were Against It...Studer Lease Analysis

Sometimes you need to look a little deeper at an issue to see the whole picture.

Such is the case with the Studer CMPA lease that caused the Studers to end negotiations with the dynamic duo (Mayor Hayward and Council President Andy Terhaar).

If you look at the 24 issues presented to Council by BEGGS & LANE, the law firm keeps making suggestions to stiffen the lease approved by the CMPA.  These new measures were sent to Council to show them the areas where the City and Studer needed additional negotiation (read PRESSURE ON QUINT TO SIGN).

Simple enough right?

So here's the rub.  Beggs & Lane in 2013 while representing the City in a variety of matters was the attorney's for Beck Properties when they negotiated their lease for Maritime One with the City and CMPA.

See-Page-29-of-Beck-Lease-for Beggs & Lane

MANY OF THE ITEMS BEGGS & LANE objected to in the Studer lease, THEY WERE FOR when they included them in the lease for their client, Beck against the City and CMPA.

So why the change?  Well Quint is a wealthy, transplant who is generous and wants to move Pensacola forward.  Beck is a GOB and everyone knows GOBS get better deals with Hayward. (Ask Pate)

So Beggs & Lane was for the lease terms before they were against the lease terms.

Can anyone at City Hall find the conflict waiver letter the City signed to allow Beggs & Lane to represent Beck against the City?

Open you mouth and you own your words!  In a AM 1620 interview yesterday City Administrator Eric Olson stated:

Both of the emails below end with
Both emails are presumed to be sent from City computers as they are during work hours.

Mr Olson, does City time and City resources need to be spent by your Chief Human Resource Officer emailing staff pictures of his dog?

If your Human Resource Officer is not leading by example, is that an issue?

From the City of Pensacola HR Manual...Olson Violation Clear

Excerpts from the City HR Manual

The City reserves the right to take disciplinary action, up to and including discharge, against any employee who has engaged in conduct which is contrary to the order, efficiency, or good name of the City, or conflicts with the best and valid interests of the City, its employees, and constituents.

The continued success of City government is dependent upon the trust of residents, businesses, and others we serve. We are committed to preserving that trust. Each employee must recognize that the actions of any one employee can enhance or damage the reputation of all City employees. Each employee owes a duty to the City of Pensacola to act in a way that will merit the continued trust and confidence of the public.

Compliance with this policy of ethics and standard of conduct is the responsibility of every employee. Disregarding or failing to comply with this standard of business ethics and conduct can lead to disciplinary action, up to and including termination of employment.

Olson's Specific Violations

The general standard of conduct is that each employee should avoid any action which might result in or create the appearance of:

1. Using his or her public office for private gain;
2. Offering preferential treatment to any person;
3. Impeding the efficiency or economy of the City of Pensacola government;
4. Compromising the independence or impartiality of his or her office;
5. Adversely affecting the confidence of the public in the integrity of the City of Pensacola; or
6. Receiving compensation from any source other than the City of Pensacola for performing official duties for any work performed on behalf of or in connection with official City business.

City employees must, at all times, comply with all applicable laws and regulations. The City will not condone the activities of employees who achieve results through violation of the law or unethical business dealings. The City does not permit any activity that fails to stand the closest possible public scrutiny.

Look who is now blogging for the Mayor

Bob Kerrigan
This is one of many poorly written and factually wrong articles harming our city's image. There is no "order to show cause" the writer simply took a statement from a lawyer and printed it as true. A court would have to issue such an order and it would have taken ten minutes to determine no such order existed. The new policy of the PNJ is to write an insulting unfair article and then if the target of the insult ignores the invitation to respond the PNJ writes that there was no response, a cheap trick to make it look like it must be true. While everyone in our City government and virtually all local business people are trying to bring jobs here the PNJ is doing everything it can to prevent it from happening. The message to other potential investors from these attacks on the Mayor and the City Council by these inflamatory and vendictive Andy Marlette editorials: stay away from our city. Conducting "on line" push polls and creating controvesy is better suited for a weekly paper trying to entice people to read it, not a Gannett publication. No wonder many public officials have refused to talk to the PNJ. How disgraceful it must be for the many fine empoyees of the PNJ to see what is happening to this newspaper. And all to sell a few more papers.

Randy Hammer appears to be right on target with his article!

Eric Olson's "Illegal" Attempt to Have a Citizen Fired Using Lies About Her Emails

On July 2, 2015, at 9:46:29 AM, City Administrator Eric Olson was going to get even.  He had evidently become irritated that a Pensacola citizen kept pressing some zoning issues effecting her neighborhood and was making public records requests.  He had learned where the Citizen worked and he was going to get her.

City phone records reflect that at that time City Administrator Eric Olson, a Naval Academy graduate, picked up his City phone and called the local commanding officer of the Citizens employer. The Citizen is a Federal government employee with many years of service at the base.

Representing himself as the "City Administrator" Olson proceeded to talk Navy talk with the Lieutenant Commander.  Experiences, do you know so and so, etc etc.

Then Olson went in for the kill.

Olson represented to the officer that an employee in the command had "sent about 300 emails to the City from her Federal government email account"  He stated he had the emails in front of him and that the City had issues with the Citizens activities.  Olson must have known from his Navy experience that extensive use of Government email accounts for non-government business was a significant employee violation.

Upon ending the call, the Commander initiated an internal investigation of the Citizen's emailing activities from her government account.  Just a few emails were noted and of those few two were "thank you" emails to City officials.

The Commander wanted to see whether he had missed something in the investigation and called City Administrator Olson to request to see the emails. This should have been an easy request as Olson had stated that the emails were "in front of me".  Olson began crabbing immediately upon being asked  to produce the emails, finally admitting to the Commander no such stack of hundreds of emails existed.

The Citizen who has been active in civic affairs for years was appalled by the actions of City Administrator Eric Olson.  She has retained Counsel and a cease and desist letter was sent to Mayor Ashton Hayward on July 20, 2015.  To date, no action has been taken by the City regarding the complaint.

Based on the letter from the attorney, Alistair McKenzie, Eric Olson acting as City Administrator has with malice of forethought attempted to have a Citizen of Pensacola, who pays his salary, fired from her job by means of false and slanderous statements to her employer.

Has Olson apologized? NO!
Has the Mayor done anything? NO!
The City has not even acknowledged the letter.

This illegal activity is documented in the following two documents:

Eric Olson, Naval Academy Graduate, you have no honor.  Do you remember the Honor Concept?

"Midshipmen are persons of integrity: They stand for that which is right.
They tell the truth and ensure that the full truth is known. They do not lie."

Eric Olson must be immediately separated from the City as slanderous attacks on the Citizens by the Mayor's staff can not be tolerated.  The proof is clear.

What will the Mayor do?

Scrubs are out!

Hayward Can't Even Be Transparent In Telling Council Fountain is OUT!

In a transmittal to Council found below, Mayor Hayward can't even be transparent with the Citizens in announcing Tamara Fountain's resignation.

"I named Ms. Fountain as my COO last August so that she could take responsibility for several important projects, many of which are now close to completion."

Oh...I see.  She was planning to exit.  This was planned all along!  We are all missing the story!

Her resignation is accepted effective the same day, but planned...I'm sure... months in advance.

Hayward would not know transparency if it smacked him the face.

We will see how transparent he is tomorrow!

Rick Outzen Nails It!

Well said Rick!

Fountain a Scrub...Scrubs are Out!

I prepared her actual resume over the weekend.  Here it is.  All of the roles are supported by publicly available documents and just reemphasize that she had NO BUSINESS BEING EMPLOYED IN HER ROLE.

I bet Sisson had a box ready this morning!  He should get one for himself for not checking her credentials himself.

It took a while for everyone to catch up!

Here's a recap of her illustrious career as I tracked it on my blog.

Fountain Background

If you want to find out about Tamara Fountain's background the trail only runs through Navarre and Hayward confidant Ken Fountain then over to Tallahassee to her first marriage until 2002.

Leon County records tell some more of the story!
  • College dropout to get married in 1993
  • operated small company Bella Bella for a while
  • owned Countryside Homes of GA & FL Inc with her husband
  • as Countryside Homes was sued by the Thrifty Nickel for nonpayment
  • had Personal Federal Tax Liens
  • Sued over Wakulla Springs Acres Mobile Home Park
  • Went back to College in 2000 and dropped out again in 2002.
Folks, that's eight (8) years at FSU with no (zero) degrees.

It looks like excellent previous experience to run the Pensacola International Airport, Pensacola Energy and the Port of Pensacola.

It appears the City job is the first time Tamara has ever worked for someone she wasn't married to.

According to the PNJ, Hayward didn't even ask for a resume before he hired her and now she runs the City's enterprises.
  • Dan Flynn with a degree in your field, when you put together an FAA plan and Fountain says YOU are unqualified and SHE knows better and threatens your job, remember she has over 8 years of college experience (with little to show for it).
  • Don Suarez next time she tells you what to do, remember, Fountain ran several of her husbands businesses.
  • Amy Miller, the next time she asks about Deepflex paying vendors, forget your 22 years of experience in ports, she has been running from vendors since 1998.
