Reeves Drives CMPA off the Ranch...Jeopardizes CMPA Bonds

You just knew when Big Stuff took the reigns of the CMPA it was just a matter of time until the rules went out the window.

On February 19th, the Community Maritime Park Association Board took action to change their by-laws to allow the CMPA appoint five members of the CMPA board.  I have been informed that the appointment of board members has been a matter of interest to the Council and may have legal ramifications not considered by the CMPA at the time of their action.

Well the problem is the CMPA had to become an instrumentality of the City in order to serve as the recipient of the tax-exempt bonds and New Market Tax Credits.

The Council Resolution doing such provided, without question, "the City to appoint and remove all twelve (12) CMPA trustees."

As predicted, Escambia County Mayor Ashton Hayward pushed through his ST Aerospace Interlocal dictating to the County Commission what they will do with THEIR MONEY to support HIS project.

Newsom Goes to Day Care

I understand Interim County Administrator Newsom went to City Hall to discuss the $1,000,000 appropriated (budgeted) and unencumbered (not committed) the Mayor has in his Economic Development Trust Fund and the possibility that the City contribute that amount to the ST Aerospace deal to lessen the impact on the County's LOST Fund.

You see, the County is potentially going to be short of the funds it needs to accomplish the OLF Field land swap it is committed to do for Navy Federal.

Pretty clear.  County may come up short on project needs.

I understand the City minions whined a lot about the pensions and were unwilling to commit the available $1,000,000.  Mr. Newsom came away with nothing but what the Mayor dictated to the Commission.

Asmar for County Judge - WOW! What a stretch.

Below is a link to the Judicial Application of John F Asmar for the role of County Judge.  Let me give you a few highlights and qualifications from Mr. Asmar's esteemed legal career.

  • Total years licensed to practice - 9
  • Lives "officially" with his mom. Property Card

Ambushed Again...Mayor to Push through Interlocal the Way HE Wants Thursday

The Interlocal agreement I provided yesterday for ST Aerospace is set to be voted on by Council Thursday AS IS before the Commission gets to weigh in on the City's available $1 million contribution.

Mayor to Commissioners: It's MY Project! You Pay, I'm NOT Chumps!

A recent PNJ article noted that the County Commission discovered that the City has $1,000,000 appropriated (budgeted) and unencumbered (no present use) sitting in an Economic Development Incentive Fund on its financial statements at December 31, 2013.  The County is sending Larry Newsom to ask why it can't be contributed by the City to the ST Aerospace deal to lessen the impact on the County's LOST funds.

The Economic Development Incentives Fund revenue and expenditures are recorded in the General Fund. At the end of FY 2013 the Economic Development Incentives Fund had a designated fund balance of $1 million which was carried forward to FY 2014. Currently the only ongoing revenue is derived from Lease Fees.

For the first quarter the “Economic Development Incentives Fund” account contributions equaled $29,098 and there were no expenditures and encumbrances. Before any expenditures or encumbrances occur, a plan will be brought before Council for approval. The unencumbered balance in the “Economic Development Incentives Fund” at the end of the first quarter was $1,029,098.

No doubt about it.  It's there!!

But in his staff recommendation to Council, His Royal Highness pushes Council an interlocal based on the City not contributing a cent until.......AFTER THE NEXT MAYORS TERM IS OVER.

The recommendation states:

County Staff has identified the $1 million in the Economic Development Incentive Fund within the General Fund as being a potential revenue source to reduce the $3.2 million provided to the City. It is City Staff’s recommendation that this revenue source not be used to fund the Project.

Don't you get it Commissioners.  Bow down, kiss the ring, give the City the money and Mayor Hayward will recognize you in the third row as a group at the groundbreaking of HIS signature deal.

Commissioner Barry I hope Molino, Bratt and Century kids understand you knew the City had money but you didn't want to demand it so they can't have a park until 2019.

Commissioner Robinson gets a free pass because the City pays for most of his districts projects and the SRIA pays the rest.  Nice!

Opposing candidates remember whether their District representatives fought for them and their neighborhoods or played reindeer games.

After all, you Commissioners need to understand "It is City Staff’s recommendation that this revenue source not be used to fund the Project."

Our Charter is a HOT MESS

When Charter Mama and the rest of her crew finalized the document which became our City's Charter no one really realized just how bad of a document it is.

Lets recap the issues its contradictions and vagaries have caused:
  • Power to hire Council staff
  • Power of Council to interact with city staff
  • Power of the veto
  • Power to contract
  • Power to approve contracts
  • Power to approve bonuses
  • Power to hire "administrators" versus "Directors"
  • etc, etc etc
Its pitiful.

Now Robert De Varona has contracted with Clark Partington to get their opinion if the Mayor can have control over extending airport contracts.

Asmar for County Judge - Death Blow

When a person wants to be a judge I assume there are a couple of key traits that are looked for:
  • Has the person lived a fairly clean and honorable life (including any potential expunged items)
  • Is the person respected by his peers and the people who will come before him
The application for the judge position has the following question:

Well, Asmar had better have spent some time detailing all of them.  I am aware of the following:

Seems like a semi important one for a Judge.

Hope he included those on the application. 
I'll be sharing all of my documents with the Governor's office for consideration.

When one looks at the career of Judicial Candidate John Asmar one has to admit that his treatment of employees here in Pensacola is consistent with his past actions.

"Two top city administrators used city computers to swap e-mails that included a picture of overweight black women in thong bikinis, jokes about a sperm bank and other sexual innuendo and discussions about a private business enterprise, a St. Petersburg Times review shows.

Interim City Manager Bill Horne said Monday he would admonish Garry Brumback, assistant city manager, and John Asmar, planning and development administrator, for showing poor judgment by sharing the racy e-mail. "

Asmar for County Judge - Part 2

The St. Pete Times wrote a story reporting Asmar:
 
  • Resigned from Escambia County after being rebuked for trying to pervert the legal system and fix a ticket by swaying a judge
  • Was sued by a former employee for age discrimination
  • Was asked to resign by City Council members for making personal charges to a City credit card
  • Knowingly charged City customers for a fee the Florida Supreme Court had previously found illegal
  • Has a "dictatorial style"
  • Was criticized by the former head of a NAACP chapter for not hiring minorities and women

Fish Hatchery Due Diligence Required

The City has built a $56 million waterfront park, a world class stadium and the ECUA has a very valuable piece of property across the street for future expansion.  A lot of potential.

But His Royal Highness and his giant ego want a fish hatchery right across the inlet from the CMP.  This item will be before the City Council soon with the PNJ set to run a detailed Sunday story this weekend on the hatchery plan.

It Stinks – Having grown up in Sacramento, I have to say that the hatchery just isn't that cool. I was taken there countless times by schools, youth groups, day camps, etc. and after about the first ten minutes, it's just not that fun to throw little fish pellets at the fish. Plus, it stinks. Quite literally. And badly.

I hope we are not creating a New Stinky!!!

FOR THE FUTURE OF OUR INVESTMENT, COUNCIL PLEASE DO A LITTLE DUE DILIGENCE. DON'T BLINDLY FOLLOW THE MAYOR.

Council pre-approved the concept.  Not the project as presented.

Cultivate a “Citizens First” culture at City Hall. Obtain feedback from surveys, comment cards and city staff to ensure the best customer service possible and responsive government.

Wow!  Where to begin?

Well let's begin with what the Mayor's office was doing until he got slapped by the State Attorney's office.

"The Independent News will submit today a public record request for city emails regarding Varona’s offer to see if the mayor and his advisors played any role in the letter. However, the city public records department will probably not fulfill the request until early March at the soonest.
The paper has requests from Jan. 11, 2014 that have yet to be answered. The city public records department can not even tell the Independent News how many outstanding requests it had as of Dec. 31, 2013.

In July 2013, the State Attorney’s Office issued a report that blistered Hayward’s administration for how it handled public record requests. New software was bought, Jane Bollard hired to run it and city staff spent a day in seminar on public records. The system has not improved. The delays in answering requests have been longer than they were a year ago.

Prior to Hayward’s administration, most requests from the Independent News were answered in no more than three days.

I’m not sure if we have been singled out for “punishment.” I won’t know that answer until the city releases information on its outstanding requests.

Solution 4

Determine the highest and best use for the Main Street wastewater treatment plant site and look at ways to attract outside capital and investment from the private sector to fulfill that use.

However, in his 2012 "State of the City Address"  Hayward stated:

"Central to that effort is the future of the 18 acres formerly occupied by ECUA’s Main Street Wastewater Treatment Plant. Given its size, and proximity to the Community Maritime Park and waterfront, its successful redevelopment is critical.  As such, we are currently exploring options for the purchase of the property. Ownership of this key site will provide the City with the opportunity to incentivize high-quality future redevelopment."

WHAT HAPPENED TO THE INVESTMENT FROM THE PRIVATE SECTOR HE TALKED ABOUT IN HIS 20 SOLUTIONS?  NOW HE WANTS TO USE OUR CASH?

On January 29, 2013 His Royal Highness even asked the ECUA for a right of first refusal on the property.

Can I Pretty Please Have an Option?

The only issue is the City has no money! So he couldn't move forward. 

So the Mayor proposed a Maritime Overlay District to control what the development on the property could look like and contain.

Mayor Hayward is obsessed with the ECUA property but to date since he has no money and since Council told him no on the overlay district, he has had no impact or SOLUTION on that property since elected.
